Texas Real Estate Commission

Consumer Protection Notice

The Texas Real Estate Commission (TREC) regulates real estate brokers and sales agents, real estate inspectors, easement and right-of-way agents, and timeshare interest providers.

License Holder Status

You can find more information and check the status of a license holder at www.trec.texas.gov

File a Complaint

You can send a complaint against a license holder to TREC. A complaint form is available on the TREC website at www.trec.texas.gov

Recovery Trust Account

TREC administers the Real Estate Recovery Trust Account which may be used to satisfy a civil court judgment against a broker, sales agent, or easement or right-of-way agent, if certain requirements are met.

Inspector Insurance

Real estate inspectors are required to maintain errors and omissions insurance to cover losses arising from the performance of a real estate inspection in a negligent or incompetent manner.

Note

Inspectors may limit liability through provisions in the contract or inspection agreement between the inspector and their clients. Please be sure to read any contract or agreement carefully. If you do not understand any terms or provisions, consult an attorney.

Your Rights as a Buyer

  • You have the right to be represented by a licensed real estate agent who works exclusively in your best interest.

  • You have the right to receive all material facts about a property that may affect its value or desirability.

  • You have the right to negotiate the terms of any real estate transaction, including price, closing costs, and repairs.

  • You have the right to have all agreements in writing and to receive copies of all documents you sign.

  • You have the right to a professional home inspection before closing and to negotiate based on findings.

  • You have the right to a final walk-through of the property before closing.

  • You have the right to know about any known defects, legal issues, or disputes affecting the property.

Your Rights as a Seller

  • You have the right to set your listing price and reject any offer that does not meet your needs.

  • You have the right to receive full disclosure from your agent about any potential conflicts of interest.

  • You have the right to understand all costs associated with selling, including commissions, closing costs, and taxes.

  • You have the right to be kept informed of all offers and to respond to each on your own timeline.

  • You have the right to cancel a listing agreement if your agent is not fulfilling their contractual obligations.

  • You have the right to privacy — your personal information will never be shared without your consent.

Fair Housing Rights

  • Under the Fair Housing Act, it is illegal to discriminate based on race, color, national origin, religion, sex, familial status, or disability.

  • Every buyer and seller is entitled to equal, professional service regardless of background or identity.

  • If you believe you have experienced discrimination in a real estate transaction, you may file a complaint with the U.S. Department of Housing and Urban Development (HUD).

  • Texas law additionally prohibits discrimination based on ancestry and source of income in certain circumstances.
